Chapter 18. BUILDINGS AND BUILDING REGULATIONS |
Article I. IN GENERAL |
§ 18-1. Definitions.
The words, terms and phrases below will have the following meaning unless the context clearly indicates otherwise:
Advertise and advertises shall apply to business cards, business proposals, contracts, construction site signs, all newspapers, airwave transmission (other than internal company communications), any electronic media including Internet sites, phone directory, and other media including handbills, billboards, flyers, shopping and service guides (coupon offerings), magazines (including trade associations publications), classified advertisements, manufacturer's "authorized dealer" listings, and signs on vehicles. They shall not apply to balloons, pencils, pens, hats, shirts, articles of clothing, or other promotional novelties. Neither shall the terms apply to any single line phone directory listing; nor to free phone directory listings (regardless of page color) of one, two or three lines, which display nothing more than the proper name, company name, address, and telephone numbers in whole and in part in an unbolded or unhighlighted print or without further textual or pictorial elaboration or touting in its overall display.
Building official means the person holding a license as a building official and so designated by the board of county commissioners. Any time the words "building official" appear in this chapter, the term shall also include his designee or any licensed building inspector working under his supervision.
Building systems means the structural, electrical, mechanical, gas, and plumbing components of a building or structure.
Central permitting manager means that officer, or his designee working under his supervision.
Credit report from a nationally recognized credit agency means report that provides full, accurate, current, and complete information on the following items in a manner which allows the board to determine the credit worthiness of the applicant:
(a)
Payment history;
(b)
Credit rating;
(c)
Public filings in county, state and federal courts;
(d)
Bankruptcies, business history, suits, liens, and judgments, all on a nationwide basis;
(e)
Location of business, number of years in business;
(f)
Social security numbers, if available, of all corporate officers, owners and partners, and all federal employer identification numbers, if available, held by the applicant or any business entity that he currently qualifies or is applying to qualify; and
(g)
UCC filings.
Board means the Pasco County Construction Board.
Business organization or business entity means any partnership, corporation, business trust, joint venture, or other legal entity that engages in the business of contracting or acts as a contractor.
Certificate of competency means a license granted by the board to contract for a particular type of construction services within Pasco County.
Code enforcement officer means any designated employee or agent of Pasco County whose duty it is to enforce county codes and ordinances.
Contracting means engaging in business as a contractor and performing acts attributable to a contractor. The attempt to sell contracting services and the negotiation or bid for contract services also constitutes contracting. If the construction services offered require licensure or agent qualification, then the offer, negotiation for a bid, or attempt to sell these services requires the corresponding licensure.
Contractor means the person who is qualified and responsible for the contracted project; or the person who, for compensation, undertakes, submits a bid to, or does by himself or through others construct, repair, alter, remodel, add to, subtract from, demolish or improve any building or structure, including related improvements to real estate, for others or for resale; and whose job scope is substantially similar to the job scope described in one of the subsequent paragraphs of this definition. For the purposes of licensing regulation under this chapter, "demolish" applies only to demolition of steel tanks over 50 feet in height; towers over 50 feet in height; other structures over 50 feet in height, other than buildings or residences over three stories tall; and buildings or residences over three stories tall.
(a)
"General contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(b)
"Building contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(c)
"Residential contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(d)
"Sheet metal contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(e)
"Roofing contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(f)
"Class A air-conditioning contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(g)
"Class B air-conditioning contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(h)
"Class C air-conditioning contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(i)
"Mechanical contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(j)
"Commercial pool/spa contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(k)
"Residential pool/spa contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(l)
"Swimming pool/spa servicing contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(m)
"Plumbing contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(n)
"Underground utility and excavation contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(o)
"Solar contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(p)
"Pollutant storage systems contractor" has the same meaning as in F.S. § 489.105, which is incorporated by reference.
(q)
"Specialty contractor" means a contractor whose scope of work and responsibility is limited to a particular phase of construction and whose scope is limited.
(r)
"Aluminum contractor, structural" means a contractor whose services consist of the installation, fabrication, maintenance (except for cleaning), repair or design with aluminum, vinyl and fiberglass screen material. The aluminum contractor may work on foundations, slabs on grade and block knee walls, wood decks (self-standing) and utility sheds (wood studs only) less than 501 square feet, necessary to and incidental to the aluminum construction work. The aluminum contractor shall not perform any work that alters the structural integrity of the building and shall not use wood products for rafters, trusses and wood beams.
(s)
"Carpenter" means a contractor whose services consist of the installation of any wood products for the framing inside or outside of any building or structure.
(t)
"Concrete contractor" means a contractor whose services consist of pouring and finishing of concrete floors and foundations designed to accept any structure when in the design of that structure a footer is required.
(u)
"Masonry contractor" means a contractor whose services consist of the selection, cutting, or laying brick and other clay products, rough cut or dress stone, artificial stone or precast blocks or structural glass brick or block. A certificate of competency as a masonry contractor does not include pouring or finishing concrete. This license is not required for pavers or concrete curbing.
(v)
"Sign contractor, electrical" means a contractor whose services consist of the installation, repair, alteration, addition to or change of any electrical wires, apparatus, raceways, conduit or any part thereof on electrical signs. Such contractor may also contract for and take out building permits for the erection of electric signs.
(w)
"Sign contractor, nonelectrical" means a contractor whose services consist of the installation, repair, addition to or change to nonelectrical signs.
(x)
"Structural steel contractor" means a contractor whose services consist of the erection of structural steel shapes and plates, including such minor field fabrication as may be necessary, of any profile, perimeter or cross section, that are or may be used as structural members for buildings and structures, including riveting, welding and rigging.
(y)
"Irrigation sprinkler contractor" means a contractor whose services consist of the connections to a water pump, installation, maintenance, repair, alteration or extending piping and sprinkler heads for irrigation of lawns.
(z)
"Solar energy installation contractor" means a contractor whose services consist of the installation, altering, repairing or replacing of any solar hot water heating system for residences or pools, including collectors, storage and expansion tanks, heat exchangers, piping, valves, pumps, sensors and low-voltage controls which connect to existing plumbing or electrical stubouts.
(aa)
"Drywall contractor" means a contractor whose services consist of the installation of gypsum drywall products to wood and metal studs, wood and steel joists and metal runners in buildings of unlimited area and height. The scope of work shall include the preparation of the surface over which the drywall product is to be applied.
(bb)
"Tile, marble and terrazzo contractor" means a contractor whose services consist of setting tile or marble, or mix, prepare or finish terrazzo.
(cc)
"Insulation contractor" means a contractor whose services consist of the application and installation of insulation on or in walls and attics.
(dd)
"Finish carpentry" means a contractor whose services consist of performing a decorative type of woodwork either inside or outside of a structure.
(ee)
"Aluminum specialty contractor" means a contractor whose services consist of the installation of aluminum or vinyl soffit, fascia, siding, skirting, gutters and downspouts.
(ff)
"Plastering and stucco contractor" means the coating of surfaces with a mixture of sand and other aggregate gypsum plaster, Portland cement or quicklime and water or any combination of such material as to create a permanent surface coating. Such contractor engaging in such services may perform the work of the lathing contractor.
(gg)
"Glass and glazing" means a contractor whose services consist of the installation of metal frame windows and sliding glass doors into existing openings of new and existing single-family residential structures. Installation of metal frame windows and sliding glass doors into altered openings or structures other than single family residential structures requires licensure as a general, building or residential building contractor. The scope of work includes all makes and kinds of glass and glasswork including the execution of glazing, frames, panels, sashes and doors, metal frames, ornamental decoration, mirror, or tub or shower enclosures.
(hh)
"Hurricane protection installation" means a contractor whose services consist of the fabrication, repair, maintenance, installation and attachment of hurricane shutter assemblies and similar products.
(ii)
"Garage door installer" means a contractor whose services consist of the installation of new or replacement garage doors. The scope of work shall include the removal and disassembling of the existing garage door, track and spring assembly system and the installation of a new garage door, track, spring system and associated hardware. The garage door may be either a sectional overhead door, a roll-up door or a sliding panel door type. The scope of work includes the replacement of an unusable or unfit wood jamb, including rotten wood jambs, termite-damaged jambs, split wood jambs.
(jj)
"Marine contractor" means a contractor whose services are limited to construction, maintenance, alteration, or repair of seawalls, bulkheads, revetments, docks, piers, wharves, groins, and other marine structures, to include pile driving. All contractors doing the work of a marine contractor, such as marine pile driving, dock and seawall construction, jetty or breakwater, dike or revetment construction, shall be required to obtain and maintain workers' compensation coverage class code 6006F in addition to the required liability and workers' compensation insurances. General, building, and residential contractors can perform the functions of marine contractors with the required insurance coverage.
(kk)
"Painting contractor" means a contractor whose services consist of the use of spraying equipment as well as hand tools to finish both exterior and interior work. A painting contractor may do paperhanging, sandblasting and waterproofing and may clean and paint roofs, sidewalks and driveways. Products that are constructed as a replacement of stop leaks for roofs shall be installed by a roofing contractor and may not be applied by a painting contractor.
(ll)
"Mobile home installer" means a contractor whose services consist of the set up or installation of a mobile home that is a HUD product. "Set up" or "installation" means the operations performed at the occupancy site which render a mobile home or park trailer fit for habitation. Such operations include, but are not limited to, transporting; positioning; blocking; leveling, supporting (including tie down), installing foundation products, components, and systems; connecting utility systems; making minor adjustments; or assembling multiple or expandable units. A mobile home installer is required to hold a mobile home installer's license from the Bureau of Mobile Home and Recreational Vehicle Construction of the Department of Highway Safety and Motor Vehicles pursuant to F.S. § 320.8249. Set up or installation of a manufactured home that is not a HUD product but is a department of community affairs product must be done by a general, building, or residential contractor.
(mm)
"LP gas installer" means a contractor whose scope of work consists of the activities which are defined by and which require a license pursuant to F.S. ch. 527.
(nn)
The definitions of the multiple types of alarm system and electrical contractors set out in F.S. § 489.505 and F.A.C. 61G6-5.001 and 61G6-7.001 are adopted and incorporated by reference.
Employee means a person who receives compensation from and is under the supervision and control of an employer who regularly deducts the F.I.C.A. and withholding tax and provides workers' compensation, all as prescribed by law.
Licensed means a person or business entity holding a valid certificate of competency issued by Pasco County or the state.
Qualifying agent or qualifier means a person who possesses the requisite skill, knowledge, experience, and responsibility to supervise, direct, manage, and control the contracting activities as well as the financial aspects of the business organization with which he is connected; who has the responsibility to supervise, direct, manage, and control the contracting activities as well as the financial aspects on a job for which he has obtained a building permit; and whose technical and personal qualifications are verified by application, examination and licensure.
State certified contractor means any contractor who holds a certificate of competency from the department of business and professional regulation. A state certified contractor can contract in any jurisdiction in the state without fulfilling local competency requirements.
State registered contractor means any contractor who has registered with the department of business and professional regulation pursuant to fulfilling the competency requirements in the jurisdiction for which the registration is issued. Registered contractors may contract only in such jurisdictions. State registered contractors must fulfill local competency requirements in order to contract in Pasco County.
Story means that portion of a building included between the upper surface of a floor or average grade, finished or unfinished, open or enclosed, and the upper surface of the floor or roof next above and having a minimum clear height of seven feet or more.
Structure means anything built or constructed by assembling joining parts or materials.
