§ 22-83. Applicability and exemptions.
This article shall be applicable in both the unincorporated and incorporated areas of Pasco County, except to the extent that a municipality has adopted or adopts its own ordinance in conflict with this article. To the extent that this article is applicable within a municipality, the county and the municipality shall have concurrent authority and jurisdiction to apply and enforce the article within the entirety of their jurisdictional boundaries.
This article shall not be applicable to purchases of regulated or restricted regulated metals from:
(a)
Organizations, corporations, or associations registered with the state as charitable, philanthropic, religious, fraternal, civic, social or school-sponsored organizations or associations, or from any nonprofit corporation or association;
(b)
A law enforcement officer acting in an official capacity;
(c)
A trustee in bankruptcy, executor, administrator, or receiver;
(d)
Any public official acting under judicial process or authority;
(e)
A person through sale on the execution, or by virtue of any process issued by a court;
(f)
A manufacturing, industrial, or other commercial vendor that generates regulated materials in the ordinary course of business.
