§ 27-19. Reservation of rights and remedies.

(a)

The provisions of this chapter shall be applicable to all communications facilities placed in the public rights-of-way on or after the effective date of this chapter and shall apply to all existing communications facilities placed in the public rights-of-way prior to the effective date of this chapter to the full extent permitted by federal and state law, except that any provision of this chapter regarding the size, composition, or location of communications facilities shall not apply to communications facilities lawfully placed within the public right-of-way prior to the effective date of this chapter.

(b)

Nothing in this chapter shall affect the remedies the county or the communications services provider, communications facility provider, or pass-through provider has available under applicable law.
