§ 27-5. Notice of transfer, sale or assignment of assets in public rights-of-way.

  • (a)

    If a registrant transfers or assigns its registration incident to a sale or other transfer of the registrant's assets, the transferee, buyer or assignee shall be obligated to comply with the terms of this chapter. Written notice of any transfer, sale or assignment shall be provided to the county within 30 days of the effective date of the transfer, sale or assignment. Further, any such person to whom such transfer has been made must register with the county in accordance with this chapter and shall provide proof of insurance coverage in accordance with section 27-13, a performance bond in accordance with section 27-15, and a security fund in accordance with section 27-16.

    (b)

    If permit applications are pending in the registrant's name, the transferee, buyer or assignee shall notify the county administrator or designee that the transferee, buyer or assignee is the new registrant.

    (c)

    A violation of the requirements of this section shall constitute a code violation and the registrant who is alleged to have violated any of the provisions of this section may be subject to the enforcement remedies set forth in section 1-11 and section 27-10.
