§ 2-110. Award.

  • (a)

    [Authority.] The purchasing director shall have the authority to award and approve purchases of $25,000.00 or less, except as otherwise permitted in section 2-101. The county administrator shall have the authority to award and approve purchases of $50,000.00 or less, except as otherwise permitted in section 2-101. The county attorney shall have the sole authority to approve purchases of $50,000.00 or less for legal services and for goods and services required for the operation of his/her office, except as otherwise permitted in section 2-101. The board of county commissioners shall have the authority to award and approve all purchases regardless of dollar amount; however, the board of county commissioners must approve purchases that exceed $50,000.00, unless otherwise exempted in this division. Awards shall be made to the lowest, responsive and responsible bidders. For the purposes of determining the lowest responsive and responsible bidders, in addition to price, the following may be considered:

    (1)

    The ability, capacity and skill of the bidder to perform.

    (2)

    Whether the bidder can perform within the time specified, without delay or interference.

    (3)

    The character, integrity, reputation, judgment, experience and efficiency of the bidder.

    (4)

    The quality and success of previous performance.

    (5)

    The bidder's or offeror's previous and existing compliance with the laws and ordinances relating to performance.

    (6)

    The sufficiency of the bidder's financial resources and ability to perform.

    (7)

    The quality, availability and adaptability of the offered goods or contractual services to the particular use required.

    (8)

    The ability of the bidder to provide future maintenance and support for the offered good or service.

    (9)

    The materiality of exceptions and conditions attached to the bid.

    (b)

    Award to other than the lowest, responsive and responsible bidder. When the award is not given to the lowest, responsive and responsible bidder, a full and complete statement of the reasons for placing the order elsewhere shall be prepared by the purchasing director and filed with the other papers relating to the transaction.

    (c)

    Contracts. All contracts that require signature by an officer of the county for the procurement of goods and/or services which exceed $50,000.00 shall be submitted to the board of county commissioners for approval and signature, unless signature authority is otherwise specifically delegated by the board of county commissioners, except as provided in this section 2-101. The purchasing director shall have the authority to execute all contracts that require signature by an officer of the county for the procurement of goods and/or services which are equal to or less than $25,000.00, provided they are in conformance with the law and applicable rules and regulations. The county administrator shall have the authority to execute all contracts that require signature by an officer of the county for the procurement of goods and/or services which are equal to or less than $50,000.00, provided they are in conformance with the law and applicable rules and regulations. The county attorney shall have the authority to execute all contracts relating to the provision of legal or legal related services that require signature by an officer of the county for the procurement of such goods and/or services which are equal to or less than $50,000.00, provided they are in conformance with the law and applicable rules and regulations.

    (d)

    Change orders/modifications.

    (1)

    All written alterations or change orders issued against a quote, bid, task order, or contract that exceed $50,000.00 and that alteration or change order has a dollar value of $50,000.00 or more shall be submitted to the board of county commissioners for approval prior to execution of such modifications or changes.

    (2)

    The purchasing director shall have the authority to approve and execute all written alterations or change orders relating to a quote, bid, task order, or contract which has a total value equal or less than $25,000.00 which:

    (i)

    Have a cumulative value equal to or less than 50 percent of the total value of the original quote, bid, task order or contract, provided they are in conformance with the law and applicable policies, rules and regulations;

    (ii)

    Name changes of the entity awarded the quote, bid, task order, or contract or the assignment by that entity to another entity of its obligations under a quote, bid, task order, formal written agreement or contract, provided they are in conformance with the law and applicable policies, rules and regulations.

    (3)

    The county administrator shall have the authority to execute all written alterations or change orders issued relating to a quote, bid, task order, or contract which has a total value equal or less than $50,000.00 which:

    (i)

    Have a cumulative value equal to or less than 50 percent of the total value of the original quote; bid, task order, or contract, provided they are in conformance with the law and applicable policies, rules and regulations.

    (4)

    The county administrator shall have the authority to execute all written alterations or change orders issued relating to a quote, bid, task order, contract involving name changes of the entity or the assignment by that entity to another entity of its obligations under a quote, bid, or contract regardless of the dollar value of the contract document; and time extensions for completion of work provided they are in conformance with the law and applicable, policies, rules and regulations.

    (e)

    Termination/cancellation. The purchasing director or the county administrator shall have the authority to terminate any contract equal to or less than $50,000.00 for default or convenience as provided under the terms of such contracts by written notice to the vendor. The county administrator shall have the authority to terminate contracts having a total value exceeding $50,000.00 with notification to the board of county commissioners at the next regular board meeting.
