§ 66-67. Definitions.
As used in this division, the following terms mean:
Child, children, or minor means individuals whose chronological age is under 18 years.
Child care facility has the same meaning as provided in F.S. § 402.302, and which are publicly identified by Pasco County, Florida on its website. These locations identified on the county's website shall also be available to the public in response to phone inquiries to designated Pasco Sheriff's Office personnel. This definition does not include a "family day care home" as defined in F.S. § 402.302.
Convicted or conviction means a determination of guilt which is the result of a trial or the entry of a plea of guilty or nolo contendere, regardless of whether or not adjudication is withheld. A conviction for a similar offense includes, but is not limited to: a conviction by a federal or military tribunal, including, courts-martial conducted by the Armed Forces of the United States, and includes a conviction or entry of a plea of guilty or nolo contendere resulting in a sanction in any state of the United States or other jurisdiction. A sanction includes, but is not limited to, a fine, probation, community control, parole, conditional release, control release, or incarceration in a state prison, federal prison, private correctional facility, or local detention facility.
Loiter or prowl means to be in or at a location at a time or in a manner not usual for law-abiding individuals, under circumstances that warrant a justifiable and reasonable alarm or immediate concern for the safety of minors in the vicinity. Among the circumstances which may be considered in determining whether such alarm or immediate concern is warranted includes, but is not limited to: the fact that the person takes flight upon appearance of a law enforcement officer, refuses to identify himself or herself, or manifestly endeavors to conceal himself or herself.
Park means all public property specifically designated by Pasco County, a municipality, or a CDD as being used for recreational purposes and where children regularly congregate, and which are publicly identified by Pasco County, Florida on its website. These locations identified on the county's website shall also be available to the public in response to phone inquiries to designated Pasco Sheriff's Office personnel.
Playground means a designated independent area in the community or neighborhood that is designated for children by Pasco County, a municipality, or a COD, and which has one or more play structures, and which is publicly identified by Pasco County, Florida on its website. These locations identified on the county's website shall also be available to the public in response to phone inquiries to designated Pasco Sheriff's Office personnel.
Permanent residence means a place where the person abides, lodges, or resides for five or more consecutive days.
Reside means to abide or lodge in a place (1) for five or more consecutive days; or (2) for a period of five or more days in the aggregate during any calendar year.
Residence means a temporary, permanent, transient residence.
Sexual offense means a conviction after the effective date of Ordinance No. 15-09 under F.S. § 794.011, 800.04, 827.071, 847.0135(5) or 847.0145, or a similar law of another jurisdiction, and in which the victim or apparent victim of the sexual offense was less than 16 years of age, or a conviction for an offense that occurred after the effective date of Ordinance No. 15-09 under F.S. § 943.0435, 775.21, or 944.607. The term excludes conviction under F.S. § 794.011(10).
School has the same meaning as provided in F.S. § 1003.01 and includes a private school as defined in F.S. § 1002.01, a voluntary prekindergarten education program as described in F.S. § 1002.53(3), a public school as described in F.S. § 402.3025(1), and the Florida School for the Deaf and the Blind, but does not include facilities dedicated exclusively to the education of adults. This definition does not include a "home education program" as defined in F.S. § 1002.1.
Sexual predator has the same meaning as provided in F.S. § 775.21, excluding persons who have been removed from the requirement to register as a sexual predator.
Sexual offender has the same meaning as provided in F.S. § 943.0435, excluding persons who have been removed from the requirement to register as a sexual offender.
Temporary residence means a place where the person abides, lodges, or resides, including, but not limited to, vacation, business, or personal travel destinations in or out of this state, for a period of five or more days in the aggregate during any calendar year and which is not the person's permanent address or, for a person whose permanent residence is not in this state, a place where the person is employed, practices a vocation, or is enrolled as a student for any period of time in this state.
Transient residence means a place or county where a person lives, remains, or is located for a period of five or more days in the aggregate during a calendar year and which is not the person's permanent or temporary address. The term includes, but is not limited to, a place where the person sleeps or seeks shelter and a location that has no specific street address.
