Article III. REGULATIONS PERTAINING TO SECURITY ALARM SYSTEMS |
§ 66-75. False alarms; violation.
False alarms are a violation of this Code. Successive false alarms that occur during the same calendar day, and to which the Pasco Sheriff's Office makes a separate response are considered separate violations of this article. Audible alarms that continue after notification to a responsible party by the Pasco Sheriff's Office are considered separate violations for each hour the audible alarm continues.
Exceptions:
(a)
Alarms caused by unlawful activity or an emergency at the premises. A presumption exists that the alarm is false if the law enforcement officer responding to the alarm and finds no evidence of unlawful activity, attempted unlawful activity, or an emergency at the premises.
(b)
An alarm transmitted under a reasonable mistake of fact that unlawful activity was being or had been committed, or that an emergency existed.
