§ 6-29. Persons permitted on premises after closing.

  • (a)

    All customers must be off the premises of all establishments selling alcoholic or intoxicating beverages before the hour of 2:30 a.m. of each day, and by 3:30 a.m. at resorts, as defined in this article. Only owners and paid employees shall be permitted on the premises of any such business after the hour of 2:30 a.m., or 3:30 a.m. for resorts. All employees must be off the premises of any such business by 3:00 a.m. of each day, and by 4:00 a.m. for resorts. On New Year's Eve of each year, one-half hour shall be added to each of the times stated in this subsection. However, this subsection shall not apply to licensed employees remaining on the premises for the sole purpose of cleaning the establishment in preparation for the next day's business. In such cases, there shall be no more than two such licensed employees remaining on the premises between 3:00 a.m. and 7:00 a.m. Additionally, this subsection shall not apply to entertainers performing at such establishments, when it is necessary for the entertainers or their employees to remain on the premises after closing for the purpose of packing and removing equipment.

    (b)

    This section shall not apply to retail businesses which remain open after the hours in subsection (a) of this section for the purpose of selling goods and services other than alcoholic or intoxicating beverages to the public.
