§ 70-23. Alcoholic beverages.

  • The possession and/or use of alcoholic beverages are prohibited on any PRNR property except when approved in advance by the county administrator or designee. County administrator or designee may approve the sale, service, and/or use of alcohol by patrons at designated events on PRNR property, and may condition the approval as follows:

    (a)

    Alcohol shall be sold and/or served only by a person/entity who is authorized and licensed to sell and/or serve alcoholic beverages, and the manner of doing so shall be accomplished only in accordance with all applicable federal, state, and local laws governing the sale and serving of alcohol;

    (b)

    Sales, service and consumption of alcohol shall take place only in the area(s) of the facility and premises designated for such activities by PRNR, and is approved only in those locations, only for event attendees, and only for the duration of the event;

    (c)

    Prior to the sale, service or consumption of alcohol at the event, the sponsor shall obtain an insurance policy in a form and amount acceptable to the county's risk management department. The policy shall name Pasco County as an additional insured. The policy shall remain in effect for the duration of the event, and for the time any event attendees remain on the premises;

    (d)

    The event sponsor shall indemnify Pasco County for all damages and losses of any type which might be suffered by Pasco County or another person as a consequence of Pasco County's approval of the sale, service and/or consumption of alcohol at the event, and shall deliver an executed indemnity agreement and an executed agreement to defend to the county attorney's office for review and approval at least five business days prior to the event. Sale, service, and/or consumption of alcohol shall not occur unless and until the form of the agreements are approved by the county attorney's office; and/or

    (e)

    The event sponsor shall ensure that no person sells, serves or consumes alcohol on the premises in violation of these conditions or in violation of federal, state, or local law. This includes but is not limited to, prohibiting "BYOB" and ensuring no unauthorized consumption or provision of alcohol occurs during the event, that underage persons are not served; and that use of alcohol is confined to designated areas.
