§ 214-2. Definitions.

  • For the purpose of this chapter certain terms are defined as follows:

    (1)

    Consumer transaction means a sale, lease, assignment, award by change, or other disposition of an item of goods, a consumer service, or an intangible to an individual for purposes that are primarily personal, family, or household, or that relate to a business opportunity that requires both personal expenditure of money or property and personal services on a continuing basis, and in which the individual has not been previously engaged, or a solicitation by a supplier with respect to any of these dispositions.

    (2)

    Supplier means a seller, lessor, assignor, or other person who regularly solicits, engages in, or enforces consumer transactions, whether or not the person deals directly with the consumer.

    (3)

    Enforcing authority means the Pasco County board of consumer affairs and appeals or the Pasco County division of consumer affairs, and does not include municipalities or municipal agencies or boards.

    (4)

    Violation means a violation of any state law or county ordinance relating to consumer protection, whether civil or criminal in nature, including, but not limited to, the Florida Deceptive and Unfair Trade Practices Act, trade standards, warranties, and weights and measures.

    (5)

    Division means the Pasco County division of consumer affairs.

    (6)

    Board means the Pasco County board of consumer affairs and appeals.

    (7)

    Order means a cease and desist order issued by the enforcing authority in accordance with the provisions of this chapter.

    (8)

    Interested party or persons means any person affected by a violation, as defined in this chapter, or any person affected by an order of the enforcing authority.

    (9)

    Administrator means the administrator of the Pasco County division of consumer affairs.

    (10)

    Chairman means the chairman of the Pasco County board of consumer affairs and appeals.

    (11)

    Person means any individual, firm, association, partnership, joint stock association, trust or corporation.
