§ 214-8. Powers of board of consumer affairs and appeals.

  • The board shall have the following powers:

    (1)

    To hear complaints of alleged violations filed by the administrator and to take testimony and receive evidence relating to such complaints.

    (2)

    To authorize the institution of an action in the circuit court to obtain a declaratory judgment that an act or practice constitutes a violation.

    (3)

    To authorize the institution of an action for injunctive relief against a supplier or other person who has committed, is committing, or is threatening to commit a violation.

    (4)

    To order a supplier or other person to cease and desist from committing a violation.

    (5)

    To modify or set aside its order at any time by rehearing upon its own motion when such rehearing is in the interest of justice.

    (6)

    To issue subpoenas in the name of the board, to compel witnesses to appear and testify and produce all books, records, papers or documents.

    (7)

    To recommend to the Pasco County board of county commissioners the revocation or suspension of the occupational license of a supplier or other person where such party has been found guilty of committing continuous or habitual violations.

    (8)

    To promulgate rules and regulations for the administration of this chapter; however, such rules and regulations shall not have the effect of law.

    (9)

    To authorize the institution of appropriate legal proceedings in the circuit court to enforce the terms and provisions of its orders.
