§ 246-37. Permit required; operations restricted.

  • Any person, firm or corporation desiring to do any dredging, pumping of sand, extension of lands, construction or extension of islands or to create any obstructions in or under the waters of any of the said lakes, shall be subject to the following restrictions:

    (1)

    Prior to the beginning of any dredging operations in any of the above lakes, it shall be necessary to secure a permit from the game and fresh water fish commission.

    (2)

    There shall be no dredging within 200 feet of shoreline or in a water depth of less than ten feet.

    (3)

    There shall be no willful destruction of any aquatic vegetation by any such operations.

    (4)

    The game and fresh water fish commission may in its discretion issue and promulgate any rules or regulations with reference to the issuance of any such permits.

    (5)

    Any such operations must be completed within 22 working days.

    (6)

    Any such operations shall use only a suction-type dredge; a cutterhead shall not be permitted.

    (7)

    If excess stirring or muddy water occurs during any such operations, the operations shall cease immediately.
