§ 34-33. Additional court costs assessed in criminal, criminal traffic infractions, and delinquency cases; disposition and administration of funds.

  • Funding for the Legal Resource Center shall include the following:

    (1)

    In accordance with Section 34-9, a court cost of $65.00 shall be assessed in each case in which a person pleads guilty or nolo contendere to, or is found guilty of, or adjudicated delinquent for, any felony, misdemeanor, delinquent act, or criminal traffic offense under the laws of this state. Of the funds collected from such assessment, 25 percent of the amount collected shall be allocated to fund the Legal Resource Centers for personnel and legal materials as part of a law library function.

    The Clerk and Comptroller shall provide a quarterly report to the County that includes the amount of funds collected pursuant to this section and an itemized list of expenditures for all authorized programs and activities so that the County can comply with the requirements of F.S. § 939.185(1)(a). Any unspent funds at the close of the county fiscal year as allocated hereunder shall be transferred for use to fund innovations. as determined by the chief judge of the circuit. to supplement state funding for the elements of the state courts system identified in F.S. § 29.004, and county funding for local requirements under F.S. § 29.008(2)(a)2.

    Monies collected by the Clerk of Court, as provided herein, shall be transmitted to the Board of County Commissioners and deposited into a separate fund or account to operate and maintain the Legal Resource Centers.
